Dear Dr St. Gelais,
Thank you for contacting the European Medicines Agency. We understand that, for compatibility of licenses, Creative Commons sets up a a license and deem it compatible with their “ShareAlike” licenses, namely CC-BY-SA and CC-BY-NC-SA. Once deemed compatible, the license is officially designated a “BY-SA Compatible License” and Creative Commons publishes it in their website. The CC-BY 4.0 License is not subject to a similar process of approval.
EMA’s legal notice states: “Information and documents made available on the Agency's webpages are public and may be reproduced and/or distributed, totally or in part, irrespective of the means and/or the formats used, for non-commercial and commercial purposes, provided that the Agency is always acknowledged as the source of the material. Such acknowledgement must be included in each copy of the material. Citations may be made from such material without prior permission, provided the source is always acknowledged”.
As of today, the European Medicines Agency Legal notice has not been checked against the ShareAlike compatibility process. If any analogy can be drawn, Creative Commons’ CC-BY 4.0 license permits sharing and adapting information so long as appropriate credit is given, providing a link to the license, and indicating if changes are made. However, we cannot state that EMA’s legal notice is exactly compatible with the CC-BY 4.0. Whilst integral or partial reproduction is permitted under our legal notice, this would not amount to transform and build upon the material at will. For completeness, EMA legal notice is partially different from the European Commission’s copyright notice.
